  4. 04

    Purposes, legal bases and retention periods

    We process personal data to handle inquiries submitted via the contact form or by email, to prepare a response and an offer, for further business communication and, where applicable, to establish, pursue or defend claims. The legal basis for processing is Art. 6(1)(f) GDPR/RODO, i.e. the legitimate interest of the controller in handling correspondence, communicating with potential B2B customers and protecting against claims.

    If a contract is concluded, the data may also be processed on the basis of Art. 6(1)(b) GDPR/RODO, i.e. for the performance of pre-contractual measures or the performance of a contract. The data will be stored for the period necessary to handle the inquiry and further communication, and thereafter for the period required by law or until the expiry of limitation periods for any claims.

  5. 05

    Voluntary provision of data

    Providing data is voluntary, but may be necessary to receive a response, prepare an offer or start cooperation. If no contact details are provided, it may be impossible to process the inquiry.

    Data may be disclosed only to the extent necessary to achieve the purposes stated in this Privacy Policy, in particular to:

    • providers of hosting, email, website maintenance and IT security services;
    • companies providing accounting, legal or administrative services, if this is necessary in connection with an offer, contract or claims;
    • public authorities, if the obligation to disclose results from legal provisions.

    The controller does not sell personal data and does not make it available to third parties for their own marketing purposes.

  7. 07

    Transfer of data outside the European Economic Area

    As a rule, the controller does not intend to transfer personal data outside the European Economic Area. If tools from providers outside the EEA are used in the future, the controller will ensure the application of appropriate data protection mechanisms, in particular standard contractual clauses or other safeguards required under GDPR/RODO, and will update this Privacy Policy.

  8. 08

    Cookies and similar technologies

    The website does not use cookie tools, analytics tools or marketing tracking technologies. Therefore, the website should not install analytics, advertising or remarketing cookies on the user's device.

    If the website uses only technically necessary mechanisms for the operation of the website that do not serve to track the user or for marketing purposes, marketing consent is generally not required for this. Before publication, however, it should be confirmed with the website developer and the hosting provider whether cookies, local storage, pixels or external scripts are actually used.

    If analytics or marketing tools, maps, embedded videos, chats, advertising pixels or similar technologies are implemented in the future, this section must be updated and, where appropriate, a corresponding consent mechanism introduced.

  9. 09

    Rights of data subjects

    The data subject has the right to:

    • access the data and receive a copy;
    • rectify inaccurate personal data;
    • erase the data, provided that the conditions under GDPR/RODO are met;
    • restrict processing;
    • object to processing based on the legitimate interest of the controller;
    • data portability, provided that processing is based on consent or a contract and is carried out by automated means;
    • withdraw consent at any time, if processing is based on consent; the withdrawal does not affect the lawfulness of processing before the withdrawal;

    To exercise these rights, the controller may be contacted at: kontakt@nexolve.eu.
